Terms of Use
These Terms of Use ("Terms") are a binding agreement between you and HomeSturdy ("HomeSturdy", "we", "us") governing your use of the HomeSturdy mobile app and website (the "Service"). Please read them carefully. By creating an account, signing in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What HomeSturdy is — and isn't
HomeSturdy helps you track home-maintenance tasks, receive reminders, keep a maintenance history, and exchange quote requests with local contractors. Guidance in the app — including task orientation, "before you start / after you finish" steps, cost ranges, and recommendations on whether a task is DIY or better hired out — is general, informational content only. Some of it is generated by automated systems and may be incomplete or inaccurate. It is not a substitute for the judgment of a qualified professional, the manufacturer's instructions, or applicable codes and regulations.
2. Your responsibilities & assumption of risk
Home maintenance can involve real hazards — electricity, gas, water, heights, sharp tools, chemicals, and more. You are solely responsible for deciding whether to perform any task yourself, and for performing it safely. By using the Service you agree that:
- You will follow all applicable safety procedures, manufacturer instructions, product warnings, and local codes and regulations.
- You will consult and hire appropriately licensed professionals for any work that requires it, or any work you are not fully comfortable and competent to do safely.
- You assume all risk arising from any task you choose to perform or forgo, including any property damage, injury, or loss.
- You are responsible for verifying that any guidance is appropriate for your specific home, equipment, and situation before acting on it.
3. Contractors and third parties are independent
HomeSturdy may help you request quotes from, and communicate with, third-party contractors and service providers. Those providers are independent third parties — not employees, agents, or partners of HomeSturdy.
When you engage or hire a contractor or service provider, that provider — not HomeSturdy — is solely and fully responsible for all work they perform. This includes the quality, safety, workmanship, timeliness, and completion of the work; any materials they supply; obtaining any required permits and holding any required licensing and insurance; compliance with all applicable laws, codes, and regulations; and honoring any warranties or guarantees they offer.
HomeSturdy does not perform, supervise, inspect, control, or guarantee that work, and does not endorse or warrant any provider's licensing, insurance, pricing, or conduct. HomeSturdy is not a party to any agreement between you and a provider, and any dispute regarding work performed — including defects, delays, damage, cost, or payment — is solely between you and the provider.
4. Eligibility & your account
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the activity under your account and for keeping your credentials secure. You agree to provide accurate information and to use the Service only for lawful purposes.
5. No warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any guidance, estimate, or reminder will be accurate or complete.
6. Limitation of liability
To the maximum extent permitted by law, HomeSturdy and its founders, operators, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of property, profits, data, or goodwill, or for any personal injury or property damage, arising out of or relating to your use of (or inability to use) the Service or any task you perform or forgo — even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or US $50.
7. Indemnification
You agree to indemnify and hold harmless HomeSturdy and its founders and operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your maintenance decisions or work, your dealings with contractors, or your violation of these Terms or any law.
8. Acceptable use
You agree not to misuse the Service: no unlawful, harmful, or fraudulent activity; no attempting to disrupt, reverse-engineer, or gain unauthorized access to the Service; no uploading content you do not have the right to share; and no using the Service to harass other users or providers. We may remove content or restrict access that violates these Terms.
9. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. The sections that by their nature should survive — including assumption of risk, disclaimers, limitation of liability, and indemnification — survive termination.
10. General
If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect and the unenforceable provision is enforced to the maximum extent permitted by law. These Terms, together with our Privacy Policy, are the entire agreement between you and HomeSturdy regarding the Service. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Some jurisdictions do not allow certain limitations of liability or warranty disclaimers, so some of the above may not apply to you; in that case those limitations apply to the fullest extent permitted by law.
11. Changes to the Service and these Terms
We may modify the Service or these Terms at any time. When we make material changes to these Terms, we will update the date above and may ask you to accept the updated Terms in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in North Carolina for any dispute not subject to arbitration or small-claims resolution.
